Terms & Conditions – Habitur

1. About Habitur
   Habitur is a local company specializing in 4x4 vehicle rentals on the island of São Tomé, offering safe and flexible solutions for tourism, leisure, and work. The goal is to provide freedom of movement with permanent local assistance.

2. Rental Requirements
   The minimum rental age is 18, and a valid driving license held for more than 6 months from its issue date must be presented. A deposit is required at the time of vehicle delivery. The rental starts when the rental company hands over the keys to the client. The rental company may charge additional fees for damages, unreturned accessories, or special services. Additional drivers may be included, and a local driver service can be requested for an extra fee.

3. Delivery and Pick-up
   The vehicle is delivered clean and in good condition, confirmed in the “check-out” record, and must be returned with the same fuel level (full) and at the agreed time/location. The regular office hours are from 8:30 to 12:30 and from 14:30 to 17:00, Monday to Friday. Delivery/pick-up fees are: Airport – €5; Hotels outside the city – €20 (Cantagalo, Mé-Zóchi, Lobata), €40 (Lembá), €50 (Caué). Deliveries and pick-ups outside regular hours but between 8:00 and 20:00 incur an extra fee of €10 per delivery/pick-up. The deposit is mandatory at the time of delivery and corresponds to the value of 1 daily rate + 25%. The vehicle must be returned in a clean condition that allows verification of its state.

4. Duration and Mileage
   The rental is calculated in 24-hour periods and includes unlimited mileage unless otherwise indicated. Extensions or late returns must be communicated in advance and are subject to additional costs agreed upon with the rental company.

5. Insurance and Assistance
   All vehicles include full coverage insurance and assistance in case of breakdown or accident. The client must immediately report any damage, accident, or breakdown to the rental company. In case of an accident, the client must contact the rental company and, if necessary, the local authorities, and must not leave the scene without receiving instructions from the rental company.

6. Conditions of Use
   The client is responsible for the vehicle and its extras throughout the rental period. The vehicle must be used only on authorized roads, complying with traffic laws and avoiding damage to windows, tires, interiors, or other parts of the vehicle. It is forbidden to transport hazardous goods or use the vehicle for unlawful purposes. Fuel must be replenished to the level present at the time of delivery. Any damage or misuse is the client’s responsibility. Driving off authorized roads or in risky areas is prohibited, as is smoking inside the vehicle. The client is also responsible for fines, penalties, and sanctions incurred during the rental period. The company reserves the right to retrieve the vehicle at any time, without prior notice, in case of contractual breach. The client is also responsible for basic vehicle maintenance (tires, oil, and water in rentals over one month). Towing costs due to misuse or improper driving are also the client’s responsibility and must be immediately reported to the rental company. The rental company is not responsible for loss or theft of belongings left in the vehicle.

7. Cancellations and Changes
   Cancellations made at least 15 days before the rental start date are free of charge. Cancellations made less than 15 days before the rental start date will  incur a fee of 50% of the booking value. Date or time changes are subject to the rental company’s availability. Vehicle reservations are guaranteed up to 90 minutes after the scheduled pick-up time, with a maximum tolerance of 120 minutes. After this period, it is considered a “No-Show” and the reservation is canceled with no right to a refund. Unforeseen situations will be assessed by the rental company in conjunction with the client.

8. Payment
   Payment can be made online or in person, via bank transfer, MB Way, PayPal, or cash. The deposit is returned after verifying the vehicle’s condition. The rental amount is fixed according to the current rate and must be paid in advance. Prices are presented in euros, and if payment is made in dobras (STN), the conversion will be made at the rate of 1 EUR = 25 STN. To extend the rental, the client must go in person to the rental company’s offices at the agreed time. Extensions by email are not accepted.

9. Data Protection
   The data provided is used solely for booking purposes and communication with the client. Habitur is committed to protecting the privacy of its clients and does not share data with third parties. Personal data is processed based on the following grounds: contract execution (rental management, invoicing, complaints), compliance with legal obligations (judicial, police, tax authorities), the company’s legitimate interest (marketing, service improvement), and, where applicable, the client’s consent for promotional communications. The client may request access, correction, deletion, or restriction of their data processing. The rental company may request identity confirmation before processing such requests.

11. Final Provisions
    The contract is governed by São Tomé law, with the competent court for dispute resolution located in São Tomé, with express waiver of any other. The contract may be signed on paper or digitally. If any clause is deemed invalid, this does not affect the validity of the remaining clauses. The rental company may send personalized communications unless the client expressly objects.

General Notes
All vehicles are 4x4 and equipped with air conditioning. Rentals over 5 days receive an automatic 10% discount. Personalized services or special requests must be arranged in advance. All prices listed on the website include VAT at the legal rate in force in São Tomé and Príncipe (15%).
